Google has responded to Viacom’s $1 billion copyright lawsuit, saying that YouTube has not infringed on the rights of media companies and that Viacom’s suit threatens the viability of YouTube and of other sites like it.
Google says that YouTube is protected under the Digital Millennium Copyright Act, which states that service providers that host other people’s content are safe from liability as long as they remove material quickly once a content owner claims infringement, writes CNET News.
Viacom says YouTube is not protected because the company has prior knowledge of infringing material and is also profiting from pirated works.
Michael Kwun, managing council for litigation at Google, says that Google offers the best available tools for protecting copyright owners, including a “hash blocking system” that identifies the digital fingerprint of content that has been removed for copyright reasons.
