The FCC hasn’t started reviewing the potential deal between XM and Sirius, because the agency is still debating the substance of the rules that may or may not ban a merger, FCC chairman Kevin Martin told reporters Friday (via Bloomberg and AZ Central).
When the FCC granted licenses to satellite radio companies, it made a “statement,” says Sirius CEO Mel Karmazin. However, he said, “If you go to the rule books, I’m not sure you’ll find a rule.”
Karmazin said that he still expects a deal to be completed by the end of 2007. He called the National Association of Broadcasters’ opposition to the merger disgraceful, and accused the NAB of paying organizations and individuals to write letters to Congressmen urging them to block the deal.
Stifel Nicolaus has issued a broker research note saying that the expectations for an approved merger are now less than 50 percent, and saying that Wall Street sees only a 10 to 20 percent chance of success, according to 24/7 Wall Street. The research note says that both companies, however, are attractive on a stand-alone basis, and that they might become highly profitable in the next five years.
